These Terms of Service constitute a legally binding agreement. Please read carefully and consult with legal counsel if needed before using our services.
By accessing or using Cashelio's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. These terms apply to all users, including browsers, vendors, customers, merchants, and content contributors.
Cashelio provides a comprehensive financial technology platform offering services including but not limited to: peer-to-peer loans, digital wallets, virtual cards, escrow services, savings products (Ajo), payment processing, credit scoring, and business analytics. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
You must be at least 18 years old and a resident of a country where Cashelio operates to use our services. By using Cashelio, you represent and warrant that you meet these eligibility requirements. You must provide accurate, current, and complete information during registration and keep your account information updated.
To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to: (a) provide accurate information, (b) maintain and update your information, (c) not share your password, (d) notify us immediately of unauthorized access, and (e) accept responsibility for all activities on your account.
We are required by law to verify your identity. You agree to provide valid government-issued identification and other information as requested. We may restrict, suspend, or terminate your account if you fail to complete verification or if we detect fraudulent activity. We reserve the right to request additional documentation at any time.
You agree not to use Cashelio for: (a) illegal activities including money laundering or terrorism financing, (b) fraudulent transactions, (c) activities that violate third-party rights, (d) transmitting harmful code or malware, (e) unauthorized access to our systems, (f) manipulating or exploiting our services, (g) circumventing security measures, or (h) any activity that could harm Cashelio or other users.
Certain services may incur fees as disclosed on our website or app. All fees are in the currency specified and are non-refundable unless otherwise stated. We reserve the right to change fees at any time with 30 days notice. You authorize us to deduct applicable fees from your wallet balance or payment method on file.
Loan terms, interest rates, and repayment schedules are agreed upon at the time of loan origination. Borrowers agree to repay loans according to the agreed schedule. Late payments may incur penalties and negatively impact credit scores. Lenders acknowledge that loans carry risk and are not guaranteed by Cashelio. We act as a facilitator and are not a party to loan agreements.
When using our payment services, you authorize us to process transactions on your behalf. We are not responsible for delays or failures caused by third-party payment processors or banks. Chargebacks and disputes will be handled according to card network rules. You agree to provide accurate transaction information.
All content, trademarks, logos, and intellectual property on Cashelio are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our express written permission. Your use of our services does not grant you any ownership rights to our intellectual property.
To the maximum extent permitted by law, Cashelio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees you paid to Cashelio in the past 12 months. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
You agree to indemnify and hold harmless Cashelio, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of our services, (b) violation of these terms, (c) violation of any rights of third parties, or (d) your conduct in connection with our services.
Any disputes arising from these terms or your use of Cashelio shall be resolved through binding arbitration in accordance with the rules of the Nigerian Arbitration and Conciliation Act. The arbitration shall take place in Lagos, Nigeria. You waive the right to participate in class action lawsuits. This does not affect your statutory rights that cannot be waived.
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these terms. Upon termination, your right to use our services ceases immediately. You may close your account at any time by withdrawing all funds and following our account closure process. Sections that by their nature should survive termination shall survive.
We reserve the right to modify these terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of Cashelio after changes take effect constitutes acceptance of the new terms. If you do not agree to the modified terms, you must stop using our services.
These terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts in Lagos, Nigeria for resolution of any disputes.
